Chapter Introduction

أخبرنا الشيخ الإمام العالم شيخ الإسلام برهان الدين أبو الفتح مسعود بن شجاع الأموي بقراءتي عليه بدمشق، قال: أخبرنا الإمام أبو العلا صاعد بن أبي الفتح بن أبي الفرج المسهي رحمه الله تعالى ببخارا بقراءتي عليه وهو يسمع، قال: نا الشيخ الإمام أبو القاسم رضوان، قال: نا أبو بكر أحمد بن علي بن إبراهيم بن راهويه المعروف بالحافظ الأصبهاني، قال: حدثنا الشيخ أبو بكر محمد بن إبراهيم بن علي بن عاصم بن زاذان المقريء، قال: حدثنا الشيخ الإمام أبو جعفر أحمد بن محمد بن سلامة الأزدي الطحاوي ﵀ ⁽¹⁾، قال أبو جعفر أحمد بن محمد بن سلامة الأزدي الطحاوي رحمة الله عليه:

سألني بعض أصحابنا من أهل العلم أن أضع له كتابا أذكر فيه الآثار المأثورة عن رسول الله ﷺ في الأحكام التي يتوهم أهل الإلحاد والضعفة من أهل الإسلام أن بعضها ينقض بعضا؛ لقلة علمهم بناسخها من منسوخها، وما يجب به العمل منها لما يشهد له من الكتاب الناطق والسنة المجتمع ⁽²⁾ عليها، وأجعل لذلك أبوابا، أذكر في كل باب منها ما فيه من الناسخ والمنسوخ، وتأويل العلماء، واحتجاج بعضهم على بعض، وإقامة الحجة لمن صح عندي قوله منهم، بما يصح به مثله من كتاب أو سنة أو إجماع أو تواتر من أقاويل الصحابة أو تابعيهم.

وإني نظرت في ذلك وبحثت عنه بحثا شديدًا، فاستخرجت منه أبوابًا على النحو الذي سأل، "وجعلت ذلك كتبًا، ذكرت في كل كتاب منها جنسا من تلك الأجناس".

فأول ما ابتدأت بذكره من ذلك ما روي عن رسول الله ﷺ في الطهارات ⁽³⁾ فمن ذلك:

Na njoftoi Shejhu, Imami, i Dijshmi, Shejhu i Islamit Burhanudin Ebu el-Fet'h Mes'ud bin Shuxha' el-Umevi përmes leximit tim para tij në Damask, tha: Na njoftoi Imami Ebu el-Ala Said bin Ebi el-Fet'h bin Ebi el-Ferexh el-Mes'hi (Allahu i Madhëruar e mëshiroftë) në Buhara përmes leximit tim para tij ndërsa ai dëgjonte, tha: Na njoftoi Shejhu, Imami Ebu el-Kasim Riduan, tha: Na njoftoi Ebu Bekër Ahmed bin Ali bin Ibrahim bin Rahuje, i njohur si el-Hafidh el-Asbehani, tha: Na tregoi Shejhu Ebu Bekër Muhamed bin Ibrahim bin Ali bin Asim bin Zadhen el-Mukri', tha: Na tregoi Shejhu, Imami Ebu Xhafer Ahmed bin Muhamed bin Selame el-Ezdi et-Tahaui (Allahu e mëshiroftë) (1).

Ebu Xhafer Ahmed bin Muhamed bin Selame el-Ezdi et-Tahaui (mëshira e Allahut qoftë mbi të) ka thënë:

Më kërkuan disa nga shokët tanë prej njerëzve të dijes që të përpiloj për ta një libër në të cilin të përmend traditat e përcjella (et-athar) nga i Dërguari i Allahut ﷺ rreth dispozitave, të cilat njerëzit e devijimit dhe të dobëtit prej njerëzve të Islamit kujtojnë se disa prej tyre kundërshtojnë tjerat; kjo për shkak të pakicës së dijes së tyre rreth shfuqizuesit (nasikh) dhe të shfuqizuarit (mensukh) prej tyre, dhe se me cilën prej tyre duhet vepruar për shkak të asaj që dëshmon Libri folës dhe Suneti i rënë dakord (2). Dhe që t'i ndaj ato në kapituj, ku në çdo kapitull të përmend atë që përmban nga shfuqizuesi dhe i shfuqizuari, interpretimet e dijetarëve, argumentimin e disave kundër të tjerëve, si dhe ngritjen e argumentit për atë që më rezulton i saktë mendimi i tij prej tyre, me atë që vërtetohet e ngjashme me të nga Libri, Suneti, ixhmai (konsensusi) apo teuatiri nga thëniet e sahabëve ose tabiinëve të tyre.

Dhe unë e shqyrtova këtë dhe bëra një kërkim të hollësishëm, kështu që nxora prej tij kapituj sipas asaj që u kërkua, "dhe i bëra ato libra, ku përmenda në secilin libër një lloj prej atyre llojeve".

Gjëja e parë me të cilën fillova përmendjen e kësaj është ajo që është transmetuar nga i Dërguari i Allahut ﷺ rreth pastrimeve (3). Prej tyre është:

The Shaykh, the Imam, the Scholar, the Shaykh of Islam Burhan al-Din Abu al-Fath Mas'ud ibn Shuja' al-Umawi informed us, as I read to him in Damascus, He said: The Imam Abu al-'Ala Sa'id ibn Abi al-Fath ibn Abi al-Faraj al-Mas'hi, may God Almighty have mercy upon him, informed us in Bukhara, as I read to him while he was listening. He said: The Shaykh, the Imam Abu al-Qasim Ridwan narrated to us. He said: Abu Bakr Ahmad ibn 'Ali ibn Ibrahim ibn Rahuwayh, known as al-Hafiz al-Asbahani, narrated to us. He said: The Shaykh Abu Bakr Muhammad ibn Ibrahim ibn 'Ali ibn 'Asim ibn Zadhan al-Muqri' narrated to us. He said: The Shaykh, the Imam Abu Ja'far Ahmad ibn Muhammad ibn Salama al-Azdi al-Tahawi, may God have mercy upon him (1), narrated to us.

Abu Ja'far Ahmad ibn Muhammad ibn Salama al-Azdi al-Tahawi, may the mercy of God be upon him, said:
Some of our companions from the people of knowledge asked me to compile a book for him in which I mention the transmitted traditions from the Messenger of Allah, peace and blessings be upon him, regarding the legal rulings that the people of deviance and the weak among the people of Islam imagine contradict one another; due to their lack of knowledge of its abrogating from its abrogated [texts], and which of them is obligatory to act upon because it is attested to by the speaking Book and the agreed-upon Sunnah (2), and that I make chapters for that, mentioning in each chapter what it contains of the abrogating and the abrogated, the interpretation of the scholars, their argumentation against one another, and establishing the proof for the one among them whose statement is correct in my view, using what validly establishes it such as a Book, a Sunnah, consensus, or consecutive transmission from the statements of the Companions or their followers.

And I looked into that and researched it extensively, and I extracted from it chapters in the manner that was asked, "and I made that into books, mentioning in each book a category of those categories".

So the first thing I began by mentioning of that is what was narrated from the Messenger of Allah, peace and blessings be upon him, regarding purifications (3).
