كِتَابُ الْعِتْقِ بَابُ الْوَصِيَّةِ بِالْمَمَالِيكِ الْمُعْتَمِرُ بْنُ سُلَيْمَانَ، قَالَ: قَرَأْتُ عَنِ الْفُضَيْلِ بْنِ مَيْسَرَةَ، عَنْ أَبِي حَرِيزٍ، عَنِ الْحَسَنِ، عَنْ صَعْصَعَةَ، عَنْ أَبِي ذَرٍّ، قَالَ: سَمِعْتُ رَسُولَ اللَّهِ ﷺ، يَقُولُ: «مَنْ أَعْتَقَ رَقَبَةً مُؤْمِنَةً، فَإِنَّهُ يُجْزِئُ مِنْ كُلِّ عُضْوٍ، أَوْ يَحُوزُ مِنْ كُلِّ عُضْوٍ مِنْهُ عُضْوًا مِنَ النَّارِ». قَالَ الْبَزَّارُ: لا نَعْلَمُ رَوَاهُ عَنْ أَبِي ذَرٍّ إِلا صَعْصَعَةُ، وَلا عَنِ الْحَسَنِ إِلا أَبُو حَرِيزٍ. بَابٌ فِيمَنْ مَثَّلَ بِعَبْدِهِ قَالَ رَسُولُ اللَّهِ ﷺ: «مَنْ أَعْتَقَ نَصِيبَهُ مِنْ مَمْلُوكٍ ضَمِنَ لَهُمْ نَصِيبَهُمْ مِنْ مَالِهِ». بَابٌ فِيمَنْ أَعْتَقَ عَبِيدًا لَمْ يَسَعْهُمُ الثُّلُثُ

1. Chapter: Bequest regarding slaves

1391 - Na ka treguar Muhamed bin el-Muthenna, na ka treguar Muhamed bin el-Harith, më ka treguar Muhamed bin Abdurrahman, nga babai i tij, nga Ibn Umeri, i cili ka thënë: Ka thënë i Dërguari i Allahut (s.a.v.s.) lidhur me skllevërit: "Nëse bëjnë mirë, pranojeni; nëse sillen keq, falni; e nëse ju mundin, atëherë shitini."
Komentim El-Bezzari ka thënë: Muhamed bin el-Bejlemani është i dobët sipas njerëzve të dijes.
١٣٩١ - حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى، ثنا مُحَمَّدُ بْنُ الْحَارِثِ، حَدَّثَنِي مُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ، عَنْ أَبِيهِ، عَنِ ابْنِ عُمَرَ، قَالَ: قَالَ رَسُولُ اللَّهِ ﷺ فِي الْعَبِيدِ: «إِنْ أَحْسَنُوا فَاقْبَلُوا، وَإِنْ أَسَاءُوا فَاعْفُوا، وَإِنْ غَلَبُوكُمْ فَبِيعُوا».
شرح قَالَ الْبَزَّارُ: مُحَمَّدُ بْنُ الْبَيْلَمَانِيِّ ضَعِيفٌ عِنْدَ أَهْلِ الْعِلْمِ.
1391 - Muhammad bin al-Muthanna narrated to us, Muhammad bin al-Harith narrated to us, Muhammad bin 'Abd al-Rahman narrated to me, from his father, from Ibn 'Umar, who said: The Messenger of Allah (pbuh) said regarding slaves: "If they do good, then accept; if they do evil, then forgive; and if they overcome you, then sell."
Commentary Al-Bazzar said: Muhammad bin al-Baylamani is weak according to the people of knowledge.

1392 - Na ka treguar Ali ibn Muslimi, na ka treguar Hushejmi, na ka treguar Kevther ibn Hakimi, nga Nafiu, nga Ibn Umeri, se Profeti (s.a.v.s.) ka thënë: "Ushqejini ata me atë që hani vetë dhe vishini ata me atë që vishni vetë."
Komentim El-Bezzari ka thënë: Nuk e njohim këtë hadith nga Ibn Umeri përveçse përmes këtij zinxhiri transmetimi. Kapitulli: Rreth atij që liron një rob besimtar.
١٣٩٢ - حَدَّثَنَا عَلِيُّ بْنُ مُسْلِمٍ، ثنا هُشَيْمٌ، ثنا كَوْثَرُ بْنُ حَكِيمٍ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ النَّبِيَّ ﷺ، قَالَ: «أَطْعِمُوهُمْ مِمَّا تَأْكُلُونَ، وَاكْسُوهُمْ مِمَّا تَلْبِسُونَ».
شرح قَالَ الْبَزَّارُ: لا نَعْلَمُ هَذَا عَنِ ابْنِ عُمَرَ إِلا بِهَذَا الإِسْنَادِ.
بَابٌ فِيمَنْ أَعْتَقَ رَقَبَةً مُؤْمِنَةً
1392 - Ali ibn Muslim narrated to us, Hushaym narrated to us, Kawthar ibn Hakim narrated to us, from Nafi', from Ibn Umar, that the Prophet (pbuh) said: "Feed them from what you eat and clothe them from what you wear."
Commentary Al-Bazzar said: We do not know this from Ibn Umar except through this chain of transmission. Chapter: Regarding him who manumits a believing slave.

1394 - Na ka treguar Ibrahim ibn Abd Allah, na ka treguar Said ibn Ebi Merjem, na ka treguar Ibn Lehi'ah, nga Jezid ibn Ebi Habib, se Rabia ibn Lakit i ka treguar atij, se Abd Allah ibn Sandar i ka treguar atij nga babai i tij, se ai ishte te Zinba' ibn Selameh dhe ky i fundit ishte zemëruar me të, kështu që e kishte tredhur dhe e kishte gjymtuar (ia kishte prerë hundën). Ai erdhi te Profeti (s.a.v.s.) dhe e njoftoi atë, kështu që Profeti (s.a.v.s.) i foli me rreptësi Zinba'it dhe e liroi atë prej tij. Ai tha: "Lini një porosi (rekomandim) për mua," ndërsa ai (s.a.v.s.) u përgjigj: "Të rekomandoj te çdo musliman."
١٣٩٤ - حَدَّثَنَا إِبْرَاهِيمُ بْنُ عَبْدِ اللَّهِ، ثنا سَعِيدُ بْنُ أَبِي مَرْيَمَ، ثنا ابْنُ لَهِيعَةَ، عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ، أَنَّ رَبِيعَةَ بْنَ لَقِيطٍ حَدَّثَهُ، أَنَّ عَبْدَ اللَّهِ بْنَ سَنْدَرٍ حَدَّثَهُ عَنْ أَبِيهِ، أَنَّهُ كَانَ عِنْدَ الزِّنْبَاعِ بْنِ سَلامَةَ، وَأَنَّهُ عَتَبَ عَلَيْهِ فَخَصَاهُ، وَجَدَعَهُ، فَأَتَى النَّبِيَّ ﷺ فَأَخْبَرَهُ، فَأَغْلَظَ لِزِنْبَاعٍ الْقَوْلَ، وَأَعْتَقَهُ مِنْهُ، فَقَالَ: أَوْصِ بِي، فَقَالَ: «أُوصِي بِكَ كُلَّ مُسْلِمٍ».
1394 - Ibrahim ibn Abd Allah narrated to us, Sa'id ibn Abi Maryam narrated to us, Ibn Lahi'ah narrated to us, from Yazid ibn Abi Habib, that Rabi'ah ibn Laqit narrated to him, that Abd Allah ibn Sandar narrated to him from his father, that he was with Zinba' ibn Salamah, and that Zinba' became angry with him, so he castrated him and mutilated his nose. He then came to the Prophet (pbuh) and informed him, and the Prophet (pbuh) spoke harshly to Zinba' and set the man free from him. He said: "Give an injunction concerning me," so the Prophet (pbuh) said: "I commend you to every Muslim."

4. One Who Manumits a Share in a Slave

1395 - Na ka treguar Ibrahim ibn Ismail ibn Seleme ibn Kuhejli, i cili ka thënë: Më ka treguar babai im, nga xhaxhai i tij, nga Seleme, nga el-Hasen el-Uraniu, nga Ibn Abbasi, i cili ka thënë:
١٣٩٥ - حَدَّثَنَا إِبْرَاهِيمُ بْنُ إِسْمَاعِيلَ بْنِ سَلَمَةَ بْنِ كُهَيْلٍ، حَدَّثَنِي أَبِي، عَنْ عَمِّهِ، عَنْ سَلَمَةَ، عَنِ الْحَسَنِ الْعُرَنِيِّ، عَنِ ابْنِ عَبَّاسٍ، قَالَ:
1395 - Ibrahim ibn Isma'il ibn Salama ibn Kuhayl narrated to us, saying: My father narrated to me, from his uncle, from Salama, from al-Hasan al-Urani, from Ibn Abbas, who said:

5. Chapter: Regarding one who frees slaves when the third is insufficient

1396 - Na ka treguar Bishr ibn Halid el-Askeriu, na ka treguar Jezid ibn Haruni, na ka treguar Hammad ibn Seleme, nga Ali ibn Zejdi, nga Seid ibn el-Musejjibi, nga Ebu Seid el-Hudriu, se një burrë në kohën e të Dërguarit të Allahut (s.a.v.s.) liroi gjashtë skllevër, ndërkohë që nuk kishte pasuri tjetër përveç tyre, dhe ai burrë vdiq. Kjo gjë i arriti Profetit (s.a.v.s.), kështu që ai hodhi short mes tyre; liroi dy prej tyre dhe i la katër në skllavëri.
Komentim El-Bezzari ka thënë: Të tjerët përveç Jezidit e kanë transmetuar këtë nga Seid ibn el-Musejjibi si transmetim mursel (me zinxhir të shkëputur), ndërsa Jezidi e ka transmetuar atë me zinxhir të plotë (mutasil) një herë në Bagdad.

١٣٩٦ - حَدَّثَنَا بِشْرُ بْنُ خَالِدٍ الْعَسْكَرِيُّ، ثنا يَزِيدُ بْنُ هَارُونَ، ثنا حَمَّادُ بْنُ سَلَمَةَ، عَنْ عَلِيِّ بْنِ زَيْدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ، أَنَّ رَجُلا فِي عَهْدِ رَسُولِ اللَّهِ ﷺ، أَعْتَقَ سِتَّةَ مَمْلُوكِينَ، لَمْ يَكُنْ لَهُ مَالٌ غَيْرَهُمْ، وَمَاتَ الرَّجُلُ، فَبَلَغَ ذَلِكَ النَّبِيَّ ﷺ، فَأَقْرَعَ بَيْنَهُمْ، فَأَعْتَقَ اثْنَيْنِ، وَأَرَقَّ أَرْبَعَةً.
شرح قَالَ الْبَزَّارُ: رَوَاهُ غَيْرُ يَزِيدَ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ مُرْسَلا، وَوَصَلَهُ يَزِيدُ مَرَّةً بِبَغْدَادَ.
بَابُ الإِعَانَةِ عَلَى الْعِتْقِ
1396 - Bishr ibn Khalid al-Askari narrated to us, Yazid ibn Harun narrated to us, Hammad ibn Salamah narrated to us, from Ali ibn Zayd, from Sa'id ibn al-Musayyib, from Abu Sa'id al-Khudri, that a man during the time of the Messenger of Allah (pbuh) emancipated six slaves, and he possessed no wealth other than them, and the man died. This reached the Prophet (pbuh), so he cast lots among them; he emancipated two and kept four in slavery.
Commentary Al-Bazzar said: Others besides Yazid narrated it from Sa'id ibn al-Musayyib as a Mursal report, and Yazid connected it once in Baghdad. Chapter: Assistance in Manumission.

١٣٩٧ - Na ka treguar Hasani, na ka treguar Muslim bin Ibrahimi, na ka treguar Hamad bin Selemeh, nga Simak bin Harbi, nga Ikrimeja, nga Ibn Abbasi, se një rob e pranoi Islamin. Kur Pejgamberi (s.a.v.s.) emigroi, familja (pronarët) e tij u frikësuan se ai do ta ndiqte Pejgamberin (s.a.v.s.), prandaj e prangosën. Ai i shkroi Pejgamberit (s.a.v.s.): "Ti tashmë je në dijeni për pranimin tim të Islamit, prandaj më nis në rrugëtim ose më shpëto." Atëherë Pejgamberi (s.a.v.s.) dërgoi shtatë persona mbi një deve dhe tha: "Ndoshta do të gjeni në atë shtëpi dikë që do t’ju ndihmojë lidhur me të." Dhe Pejgamberi (s.a.v.s.) e liroi atë.
١٣٩٧ - حَدَّثَنَا حسن، ثنا مُسْلِمُ بْنُ إِبْرَاهِيمَ، ثنا حَمَّادُ بْنُ سَلَمَةَ، عَنْ سِمَاكِ بْنِ حَرْبٍ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ عَبْدًا أَسْلَمَ، فَلَمَّا هَاجَرَ النَّبِيُّ ﷺ، خَشِيَ أَهْلُهُ أَنْ يَتْبَعَ النَّبِيَّ ﷺ، فَقَيَّدُوهُ، فَكَتَبَ إِلَى النَّبِيِّ ﷺ: أَنَّكَ قَدْ عَلِمْتَ بِإِسْلامِي فَسَيِّرْنِي أَوْ خَلِّصْنِي، فَبَعَثَ النَّبِيُّ ﷺ سَبْعَةَ نَفَرٍ عَلَى بَعِيرٍ، وَقَالَ: «لَعَلَّكُمْ تَجِدُونَ فِي دَارٍ مَنْ يُعِينُكُمْ عَلَيْهِ»، فَأَعْتَقَهُ النَّبِيُّ ﷺ.
1397 - Hassan narrated to us, Muslim bin Ibrahim narrated to us, Hammad bin Salamah narrated to us, from Simak bin Harb, from Ikrima, from Ibn Abbas, that a slave embraced Islam, and when the Prophet (pbuh) migrated, his family feared that he would follow the Prophet (pbuh), so they shackled him. He then wrote to the Prophet (pbuh): "You have already known of my Islam, so set me on my way or rescue me." Thereupon, the Prophet (pbuh) dispatched seven individuals on a camel and said: "Perhaps you will find in the household someone who will assist you in his regard," and the Prophet (pbuh) manumitted him.
