1369 - Na ka treguar Junusi, i cili ka thënë: Na ka treguar Ebu Davudi, i cili ka thënë: Na ka treguar Hishami, nga Katadeja, nga Hilasi, nga Abdullah bin Utbe, i cili ka thënë: «Ibn Mes'udit i erdhën për një grua, të cilës i kishte vdekur burri pa pasur marrëdhënie me të dhe pa i caktuar mehrin. Ai refuzoi të thoshte diçka për këtë, por kur i erdhën përsëri pas një muaji, tha: Po them për këtë: O Allah, nëse është e saktë, është prej Teje, e nëse është gabim, është prej meje; asaj i takon mehri i grave të ngjashme me të, i takon trashëgimia dhe e ka obligim idetin. Atëherë u ngrit një burrë nga fisi Eshxhe dhe tha: I Dërguari i Allahut (s.a.v.s.) ka gjykuar mes nesh pikërisht kështu për Berva' bint Vashik. Ai tha: Më sillni dy dëshmitarë për këtë! Atëherë dëshmuan Ebu Sinani dhe el-Xherrahu; dy burra nga fisi Eshxhe».

- حَدَّثَنَا يُونُسُ ، قَالَ: حَدَّثَنَا أَبُو دَاوُدَ ، قَالَ:
حَدَّثَنَا هِشَامٌ ، عَنْ قَتَادَةَ ، عَنْ خِلَاسٍ ، عَنْ عَبْدِ اللهِ
بْنِ عُتْبَةَ ، قَالَ: «أُتِيَ ابْنُ مَسْعُودٍ فِي امْرَأَةٍ تُوُفِّيَ
عَنْهَا زَوْجُهَا وَلَمْ يَدْخُلْ بِهَا وَلَمْ يَفْرِضْ لَهَا، فَأَبَى
أَنْ يَقُولَ فِيهَا شَيْئًا، فَأُتِيَ فِيهَا بَعْدَ شَهْرٍ فَقَالَ:
أَقُولُ فِيهِ: اللَّهُمَّ إِنْ كَانَ صَوَابًا فَمِنْكَ وَإِنْ كَانَ
خَطَأً فَمِنِّي، لَهَا صَدُقَةُ إِحْدَى نِسَائِهَا وَلَهَا الْمِيرَاثُ
وَعَلَيْهَا الْعِدَّةُ، فَقَامَ رَجُلٌ مِنْ أَشْجَعَ فَقَالَ: قَضَى
رَسُولُ اللهِ - ﷺ - فِينَا بِذَلِكَ فِي بَرْوَعَ بِنْتِ وَاشِقٍ،
فَقَالَ: هَلُمَّ شَاهِدَيْنِ عَلَى هَذَا! فَشَهِدَ أَبُو سِنَانٍ
وَالْجَرَّاحُ؛ رَجُلَانِ مِنْ أَشْجَعَ».
1369 - Narrated to us Yunus, who said: Narrated to us Abu Dawud, who said: Narrated to us Hisham, from Qatadah, from Khilas, from Abdullah bin Utbah, who said: "Ibn Mas'ud was approached regarding a woman whose husband died and he had not consummated the marriage with her nor had he fixed a dowry for her. He refused to say anything about it.
Then he was approached about it after a month and he said: 'I say regarding it: O Allah, if it is correct, then it is from You, and if it is an error, then it is from me. She is entitled to a dowry like that of her peers, she is entitled to inheritance, and she must observe the waiting period ('iddah).'
Then a man from Ashja' stood up and said: 'The Messenger of Allah (saw) ruled among us with that regarding Barwa' bint Washiq.' He said: 'Bring two witnesses for this!' So Abu Sinan and al-Jarrah, two men from Ashja', testified."
