١٠٧٢٦ - وَعَنْ حَنَشِ بْنِ الْمُعْتَمِرِ «أَنَّهُمُ احْتَفَرُوا بِئْرًا بِالْيَمَنِ فَسَقَطَ فِيهَا الْأَسَدُ، فَأَصْبَحُوا يَنْظُرُونَ إِلَيْهِ فَوَقَعَ رَجُلٌ فِي الْبِئْرِ فَتَعَلَّقَ بِرَجُلٍ فَتَعَلَّقَ الْآخَرُ بِآخَرَ فَتَعَلَّقَ الْآخَرُ بِآخَرَ حَتَّى كَانُوا أَرْبَعَةً فَسَقَطُوا فِي الْبِئْرِ جَمِيعًا فَجَرَحَهُمُ الْأَسَدُ، فَتَنَاوَلَهُ رَجُلٌ بِرُمْحِهِ فَقَتَلَهُ، فَقَالَ النَّاسُ لِلْأَوَّلِ: أَنْتَ قَتَلْتَ أَصْحَابَنَا وَعَلَيْكَ دِيَتُهُمْ، فَأَتَى أَصْحَابُهُ فَكَادُوا يَقْتَتِلُونَ، فَقَدِمَ عَلِيٌّ - ﵁ - عَلَى تِلْكَ الْحَالِ فَسَأَلُوهُ، فَقَالَ: سَأَقْضِي بَيْنَكُمْ بِقَضَاءٍ فَمَنْ رَضِيَ مِنْكُمْ جَازَ عَلَيْهِ رِضَاهُ، وَمَنْ سَخِطَ مِنْكُمْ فَلَا حَقَّ لَهُ حَتَّى تَأْتُوا رَسُولَ اللَّهِ - ﷺ - فَيَقْضِيَ بَيْنَكُمْ، قَالُوا: نَعَمْ.
قَالَ: فَاجْمَعُوا مِمَّنْ حَفَرَ الْبِئْرَ مِنَ النَّاسِ رُبُعَ دِيَةٍ وَثُلُثَ دِيَةٍ وَدِيَةً تَامَّةً. لِلْأَوَّلِ رُبُعُ دِيَةٍ لِأَنَّهُ هَلَكَ فَوْقَهُ ثَلَاثَةٌ. وَلِلثَّانِي ثُلُثُ دِيَةٍ لِأَنَّهُ هَلَكَ فَوْقَهُ اثْنَانِ. وَلِلثَّالِثِ نِصْفُ دِيَةٍ لِأَنَّهُ هَلَكَ فَوْقَهُ وَاحِدٌ. وَلِلْآخِرِ الدِّيَةُ التَّامَّةُ. فَإِنْ رَضِيتُمْ فَهَذَا بَيْنَكُمْ قَضَاءٌ، وَإِنْ لَمْ تَرْضَوْا فَلَا حَقَّ لَكُمْ حَتَّى تَأْتُوا رَسُولَ اللَّهِ - ﷺ -.
فَأَتَوْا رَسُولَ اللَّهِ - ﷺ - الْعَامَ الْمُقْبِلَ فَقَصُّوا عَلَيْهِ، فَقَالَ: " أَنَا أَقْضِي بَيْنَكُمْ إِنْ شَاءَ اللَّهُ ". وَهُوَ جَالِسٌ فِي مَقَامِ إِبْرَاهِيمَ - ﷺ - فَقَامَ رَجُلٌ، فَقَالَ: إِنَّ عَلِيًّا قَضَى بَيْنَنَا، فَقَالَ: " كَيْفَ قَضَى بَيْنَكُمْ؟ ". فَقَصُّوا عَلَيْهِ، فَقَالَ: " هُوَ
مَا قَضَى بَيْنَكُمْ» ".
رَوَاهُ الْبَزَّارُ وَقَالَ فِي آخِرِهِ: لَا يُرْوَى عَنْ عَلِيٍّ إِلَّا بِهَذَا الْإِسْنَادِ. قُلْتُ: وَلَمْ يَقُلْ عَنْ عَلِيٍّ وَاللَّهُ أَعْلَمُ.
#10726 And on the authority of Hanash ibn al-Mu'tamir that they dug a well in Yemen and a lion fell into it. The people began looking at it, and a man fell into the well and grabbed onto another man, and that one grabbed onto another, and that one grabbed onto another until they were four. They all fell into the well and the lion wounded them. A man then reached for it with his spear and killed it. The people said to the first man: "You have killed our companions and you are liable for their blood money." His companions came and they were on the verge of fighting one another. Ali (may Allah be pleased with him) arrived during that state and they questioned him. He said: "I shall judge between you with a judgment; whoever among you is satisfied, his satisfaction shall be binding upon him, and whoever among you is discontented, then he has no right until you come to the Messenger of Allah (pbuh) so that he may judge between you." They said: "Yes." He said: "Collect from the people who dug the well a quarter of the blood money, a third of the blood money, a half of the blood money, and a full blood money. For the first, a quarter of the blood money because three perished above him. For the second, a third of the blood money because two perished above him. For the third, a half of the blood money because one perished above him. And for the last, the full blood money. If you are satisfied, then this is the judgment between you, and if you are not satisfied, then you have no right until you come to the Messenger of Allah (pbuh)." They came to the Messenger of Allah (pbuh) the following year and related the story to him. He said: "I shall judge between you, if Allah wills." He was sitting at the Station of Ibrahim (pbuh). A man stood up and said: "Indeed, Ali judged between us." He asked: "How did he judge between you?" They related it to him, and he said: "It is as he judged between you."

- Dhe nga Hanash bin el-Mu'temir: «Se ata kishin hapur një pus në Jemen dhe në të ra një luan. Ai tha: 'Mblidhni nga njerëzit që hapën pusin një të katërtën e dijes, një të tretën e dijes, gjysmën e dijes dhe një dije të plotë. Për të parin takon një e katërta e dijes sepse mbi të vdiqën tre veta. Për të dytin takon një e treta e dijes sepse mbi të vdiqën dy veta. Për të tretin takon gjysma e dijes sepse mbi të vdiq një vetë. Ndërsa për të fundit takon dija e plotë. Nëse jeni të kënaqur, ky është gjykimi mes jush, e nëse nuk jeni të kënaqur, nuk keni asnjë të drejtë derisa të shkoni te i Dërguari i Allahut - (s.a.v.s.) -'.
Vitin e ardhshëm ata erdhën te i Dërguari i Allahut - (s.a.v.s.) - dhe ia treguan ngjarjen. Ai tha: 'Unë do të gjykoj mes jush, në dashtë Allahu'. Ai ishte i ulur në Mekamin e Ibrahimit - (a.s.) - kur u ngrit një burrë dhe tha: 'Aliu ka gjykuar mes nesh'. Ai pyeti: 'Si gjykoi mes jush?'. Ata ia treguan, dhe ai tha: 'Ai është
ashtu siç ka gjykuar mes jush'».
E transmeton el-Bezzari dhe në fund të tij thotë: Nuk transmetohet nga Aliu përveçse me këtë isnad. Unë them: Dhe nuk ka thënë 'nga Aliu', e Allahu e di më mirë.
