١٠٧٤٦ - عَنْ عِمْرَانَ بْنِ حُصَيْنٍ قَالَ: «قَتَلَ رَجُلٌ مِنْ هُذَيْلٍ رَجُلًا مِنْ خُزَاعَةَ فِي الْجَاهِلِيَّةِ، وَكَانَ الْهُذَلِيُّ مُتَوَارِيًا فَلَمَّا كَانَ يَوْمُ الْفَتْحِ وَظَهَرَ النِّدَاءُ ظَهَرَ الْهُذَلِيُّ، فَلَقِيَهُ رَجُلٌ مِنْ خُزَاعَةَ فَذَبَحَهُ كَمَا تُذْبَحُ الشَّاةُ.
فَرَفَعَ ذَلِكَ إِلَى النَّبِيِّ - ﷺ - فَقَالَ: " أَقَتَلْتَهُ قَبْلَ النِّدَاءِ أَوْ بَعْدَ النِّدَاءِ؟ ". فَقَالَ: بَعْدَ النِّدَاءِ، فَقَالَ رَسُولُ اللَّهِ - ﷺ -: " لَوْ كُنْتُ قَاتِلًا مُؤْمِنًا بِكَافِرٍ لَقَتَلْتُهُ، فَأَخْرِجُوا عَقْلَهُ ". فَأَخْرَجُوا عَقْلَهُ، وَكَانَ أَوَّلَ عَقْلٍ فِي الْإِسْلَامِ».
رَوَاهُ الْبَزَّارُ، وَرِجَالُهُ وَثَّقَهُمُ ابْنُ حِبَّانَ، وَرَوَاهُ الطَّبَرَانِيُّ بِاخْتِصَارٍ.
#10746 10746 - On the authority of Imran bin Husayn, who said: "A man from Hudhayl killed a man from Khuza'ah during the pre-Islamic period (Jahiliyyah). The Hudhayli man remained in hiding, but when the Day of the Conquest [of Mecca] occurred and the proclamation [of safety] was announced, the Hudhayli man appeared. A man from Khuza'ah encountered him and slaughtered him just as a sheep is slaughtered. This matter was brought before the Prophet (pbuh), and he asked: 'Did you kill him before the proclamation or after the proclamation?' He replied: 'After the proclamation.' Thereupon, the Messenger of Allah (pbuh) said: 'If I were to execute a believer for [the killing of] a disbeliever, I would have executed him; so provide his blood money (diyah).' So they provided his blood money, and it was the first blood money paid in Islam."

10746 - Nga Imran bin Husajni transmetohet se ka thënë: «Një burrë nga fisi Hudhejl kishte vrarë një burrë nga fisi Khuza'a në kohën e injorancës (Xhahilijetit). Hudheliu ishte fshehur, por kur erdhi dita e Çlirimit dhe u shpall thirrja (për siguri), Hudheliu u shfaq. Atëherë e takoi një burrë nga Khuza'a dhe e theri ashtu siç theret delja.

Kjo çështje iu dërgua Pejgamberit (s.a.v.s.), i cili tha: "A e vrave para thirrjes apo pas thirrjes?". Ai u përgjigj: Pas thirrjes. Atëherë i Dërguari i Allahut (s.a.v.s.) tha: "Sikur të isha duke vrarë një besimtar për një jobesimtar, do ta vrisja atë, prandaj jepni dëmshpërblimin (dijetin) e tij". Kështu ata e dhanë dëmshpërblimin e tij, dhe ky ishte dëmshpërblimi i parë në Islam».
