١٣١٦٠ - وَعَنْ أُمِّ مَسْلَمَةٍ «أَنَّ رَسُولَ اللَّهِ - ﷺ - أَتَاهُ أَبُو الْهَيْثَمِ بْنُ التَّيْهَانِ الْأَنْصَارِيُّ فَاسْتَخْدَمَهُ، فَوَعَدَهُ رَسُولُ اللَّهِ - ﷺ - إِنْ أَصَابَ سَبْيًا، فَلَقِيَ عُمَرَ فَقَالَ: يَا أَبَا الْهَيْثَمِ، إِنَّ النَّبِيَّ - ﷺ - قَدْ أَصَابَ سَبْيًا، فَائْتِهِ فَتَنَجَّزْ عِدَتَكَ. فَمَضَى أَبُو الْهَيْثَمِ وَعُمَرُ إِلَى رَسُولِ اللَّهِ - ﷺ - فَقَالَ: يَا رَسُولَ اللَّهِ، أَبُو الْهَيْثَمِ أَتَاكَ يَتَنَجَّزُ عِدَتَهُ. فَقَالَ لَهُ رَسُولُ اللَّهِ - ﷺ -: " قَدْ أَصَبْنَا غُلَامَيْنِ أَسْوَدَيْنِ، اخْتَرْ أَيَّهُمَا شِئْتَ ". قَالَ: فَإِنِّي أَسْتَشِيرُكَ. فَقَالَ: " الْمُسْتَشَارُ مُؤْتَمَنٌ، خُذْ هَذَا فَقَدَ صَلَّى عِنْدَنَا
وَلَا تَضْرِبْهُ، فَإِنَّا قَدْ نُهِينَا، عَنْ ضَرْبِ الْمُصَلِّينَ». قُلْتُ: رَوَى التِّرْمِذِيُّ مِنْهُ: " «الْمُسْتَشَارُ مُؤْتَمَنٌ» ". فَقَطْ.
رَوَاهُ أَبُو يَعْلَى، عَنْ شَيْخِهِ سُفْيَانَ بْنِ وَكِيعٍ وَهُوَ ضَعِيفٌ.
#13160 13160 - And from Umm Salamah, that the Messenger of Allah (pbuh) was approached by Abu al-Haytham ibn al-Tayyihan al-Ansari who asked him for a servant, and the Messenger of Allah (pbuh) promised him that if he obtained captives, [he would give him one]. Then he met 'Umar, who said: "O Abu al-Haytham, the Prophet (pbuh) has obtained captives, so go to him and seek the fulfillment of your promise." So Abu al-Haytham and 'Umar went to the Messenger of Allah (pbuh), and ['Umar] said: "O Messenger of Allah, Abu al-Haytham has come to you seeking the fulfillment of his promise." The Messenger of Allah (pbuh) said to him: "We have obtained two black youths; choose whichever of them you wish." He said: "Then I seek your advice." He said: "The one consulted is in a position of trust; take this one, for he has prayed with us, and do not strike him, for we have been forbidden from striking those who pray."

- Dhe nga Umm Seleme: «Se i Dërguari i Allahut (s.a.v.s.) i erdhi Ebu el-Hejthem bin et-Tejihan el-Ensari për t'i kërkuar një shërbëtor, dhe i Dërguari i Allahut (s.a.v.s.) i premtoi atij nëse do të merrte robër lufte. Më pas ai takoi Omerin, i cili i tha: O Ebu el-Hejthem, Pejgamberi (s.a.v.s.) ka marrë robër, shko tek ai dhe kërko përmbushjen e premtimit tënd. Atëherë Ebu el-Hejthemi dhe Omeri shkuan te i Dërguari i Allahut (s.a.v.s.) dhe ai tha: O i Dërguari i Allahut, Ebu el-Hejthemi ka ardhur te ti për të kërkuar përmbushjen e premtimit tënd. I Dërguari i Allahut (s.a.v.s.) i tha: "Kemi marrë dy djem zezakë, zgjidh cilin të duash prej tyre". Ai tha: Unë po kërkoj këshillën tënde. Ai tha: "Ai që këshillohet është i besuar, merre këtë sepse ai është falur tek ne
dhe mos e godit atë, sepse ne jemi ndaluar nga goditja e atyre që falen". Unë them: Tirmidhiu ka transmetuar prej kësaj vetëm: "«Ai që këshillohet është i besuar»".
E ka transmetuar Ebu Jala, nga shejhu i tij Sufjan bin Vaki', i cili është i dobët (daif).»
