٣٧٣ - حَدَّثَنَا أَبُو دَاوُدَ ، قَالَ: حَدَّثَنَا شُعْبَةُ ، عَنْ أَبِي قَيْسٍ ، قَالَ: سَمِعْتُ الْهُذَيْلَ «إِنَّ رَجُلًا أَتَى أَبَا مُوسَى فَسَأَلَهُ عَنْ رَجُلٍ تَرَكَ ابْنَتَهُ وَابْنَةَ ابْنِهِ وَأُخْتَهُ، فَقَالَ: لِلِابْنَةِ النِّصْفُ، وَلِلْأُخْتِ النِّصْفُ، وَأْتِ عَبْدَ اللهِ فَسَيُتَابِعُنِي، فَأَتَى عَبْدَ اللهِ فَذَكَرَ ذَلِكَ لَهُ، فَقَالَ: قَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ، لَأَقْضِيَنَّ فِيهَا بِقَضَاءِ رَسُولِ اللهِ ﷺ: لِلِابْنَةِ النِّصْفُ، وَلِابْنَةِ الِابْنِ السُّدُسُ، وَلِلْأُخْتِ مَا بَقِيَ، فَأَتَى أَبَا مُوسَى فَأَخْبَرَهُ، فَقَالَ: لَا تَسْأَلُونَا عَنْ شَيْءٍ مَا دَامَ هَذَا الْحَبْرُ فِيكُمْ».
#373 373 - Abu Dawud narrated to us, he said: Shu'bah narrated to us, from Abu Qays, he said: I heard Al-Hudhayl [saying]: "A man came to Abu Musa and asked him about a man who died leaving behind a daughter, a son's daughter, and a sister. He (Abu Musa) said: 'The daughter gets a half, and the sister gets a half. Go to Abdullah (ibn Mas'ud) and he will follow me (in this opinion).' So he went to Abdullah and mentioned that to him. He (Abdullah) said: 'Then I would have strayed and would not be of the guided. I shall judge concerning it with the judgment of the Messenger of Allah (saw): The daughter gets a half, the son's daughter gets a sixth, and the sister gets what remains.' So he went back to Abu Musa and informed him, and he (Abu Musa) said: 'Do not ask us about anything as long as this learned scholar is among you.'"

373 - Na ka treguar Ebu Davudi, i cili ka thënë: Na ka treguar Shu'be, nga Ebu Kajsi, i cili ka thënë: E kam dëgjuar El-Hudhejlin: «Një burrë erdhi te Ebu Musa dhe e pyeti për një person që kishte lënë pas vajzën e tij, mbesën (vajzën e djalit) dhe motrën e tij. Ai tha: Vajzës i takon gjysma, ndërsa motrës gjysma tjetër. Shko te Abdullah (ibn Mes'udi) sepse ai do të jetë dakord me mua. Ai shkoi te Abdullahu dhe ia përmendi këtë, e ai tha: Atëherë unë do të kisha humbur dhe nuk do të isha prej të udhëzuarve. Unë do të gjykoj për këtë me gjykimin e Pejgamberit (s.a.v.s.): Vajzës i takon gjysma, mbesës (vajzës së djalit) i takon një e gjashta, ndërsa motrës i takon ajo që mbetet. Pastaj ai u kthye te Ebu Musa dhe e njoftoi, e ai tha: Mos na pyesni për asgjë përderisa ky dijetar i madh është në mesin tuaj».
