Hadith #399 - Musnad al-Tayalisi

٣٩٩ - حَدَّثَنَا أَبُو دَاوُدَ ، قَالَ: حَدَّثَنَا الْمَسْعُودِيُّ ، عَنِ الْقَاسِمِ ، قَالَ: «بَايَعَ عَبْدُ اللهِ الْأَشْعَثَ بْنَ قَيْسٍ بِرَقِيقٍ مِنْ رَقِيقِ الْإِمَارَةِ، فَأَرْسَلَ إِلَيْهِ يَتَقَاضَاهُ، فَقَالَ الْأَشْعَثُ: بِعْتَنِي بِعَشَرَةِ آلَافٍ، وَقَالَ عَبْدُ اللهِ: بِعْتُكَ بِعِشْرِينَ أَلْفًا، قَالَ عَبْدُ اللهِ: اخْتَرْ بَيْنِي وَبَيْنَكَ رَجُلًا، فَقَالَ الْأَشْعَثُ: أَمَا وَاللهِ لَأَخْتَارَنَّ، أَنْتَ بَيْنِي وَبَيْنَ نَفْسِكَ، فَقَالَ عَبْدُ اللهِ : أَمَا وَاللهِ لَأَقْضِيَنَّ بَيْنِي وَبَيْنَكَ بِقَضَاءٍ سَمِعْتُهُ مِنْ رَسُولِ اللهِ ﷺ: إِذَا اخْتَلَفَ الْبَيِّعَانِ وَلَمْ يَكُنْ بَيْنَهُمَا بَيِّنَةٌ، فَهُوَ بِمَا يَقُولُ رَبُّ السِّلْعَةِ أَوْ يَتَتَارَكَانِ» وَيَرْوِيهِ هُشَيْمٌ، عَنِ الْقَاسِمِ، عَنْ أَبِيهِ، عَنْ عَبْدِ اللهِ.

#399 399 - Abu Dawud narrated to us, he said: Al-Mas'udi narrated to us, from Al-Qasim, who said: "Abdullah sold some slaves from the state's slaves to Al-Ash'ath bin Qays. He then sent for him to demand payment, but Al-Ash'ath said: 'You sold them to me for ten thousand,' while Abdullah said: 'I sold them to you for twenty thousand.' Abdullah said: 'Choose a man to judge between me and you.' Al-Ash'ath replied: 'By Allah, I shall choose; you are the judge between me and yourself.' Abdullah said: 'By Allah, I shall judge between me and you with a judgment I heard from the Messenger of Allah (saw): "If the two parties to a sale disagree and there is no evidence between them, then it is as the owner of the goods says, or they both cancel the deal."'" And Hushaym narrates it from Al-Qasim, from his father, from Abdullah.

399 - Na ka treguar Ebu Davudi, i cili ka thënë: Na ka treguar el-Mes'udi, nga el-Kasimi, i cili ka thënë: «Abdullahu i shiti Esh'ath bin Kajsit disa skllevër nga skllevërit e emiratit. Pastaj dërgoi t'ia kërkonte pagesën, ndërsa Esh'athi tha: 'M'i ke shitur për dhjetë mijë', kurse Abdullahu tha: 'T'i kam shitur për njëzet mijë'. Abdullahu i tha: 'Zgjidh një njeri mes meje dhe teje', ndërsa Esh'athi tha: 'Pasha Allahun, do të zgjedh; ti je mes meje dhe vetes sate'. Atëherë Abdullahu tha: 'Pasha Allahun, do të gjykoj mes meje dhe teje me një gjykim që e kam dëgjuar nga i Dërguari i Allahut (s.a.v.s.): Nëse dy shitblerësit kanë mospajtim dhe nuk ka mes tyre dëshmi (provë), atëherë vlen ajo që thotë pronari i mallit ose të dy e prishin marrëveshjen'». Dhe këtë e transmeton Hushejmi, nga el-Kasimi, nga babai i tij, nga Abdullahu.
