- حَدَّثَنَا يُونُسُ ، قَالَ: حَدَّثَنَا أَبُو دَاوُدَ ، قَالَ:
حَدَّثَنَا شُعْبَةُ ، قَالَ: أَخْبَرَنِي أَبُو عَوْنٍ الثَّقَفِيُّ ،
قَالَ: سَمِعْتُ الْحَارِثَ بْنَ عَمْرٍو ، يُحَدِّثُ عَنْ أَصْحَابِ
مُعَاذٍ مِنْ أَهْلِ حِمْصَ - قَالَ: وَقَالَ مَرَّةً: عَنْ مُعَاذٍ -،
«إِنَّ رَسُولَ اللهِ ﷺ لَمَّا بَعَثَ مُعَاذًا إِلَى الْيَمَنِ قَالَ
لَهُ: كَيْفَ تَقْضِي إِنْ عَرَضَ لَكَ قَضَاءٌ؟ قَالَ: أَقْضِي بِكِتَابِ
اللهِ، قَالَ: فَإِنْ لَمْ تَجِدْهُ فِي كِتَابِ اللهِ؟ قَالَ: أَقْضِي
بِسُنَّةِ رَسُولِ اللهِ ﷺ، قَالَ: فَإِنْ لَمْ تَجِدْهُ فِي سُنَّةِ
رَسُولِ اللهِ؟ قَالَ: أَجْتَهِدُ رَأْيِي لَا آلُو، قَالَ: فَضَرَبَ
بِيَدِهِ فِي صَدْرِي وَقَالَ: الْحَمْدُ لِلهِ الَّذِي وَفَّقَ رَسُولَ
رَسُولِ اللهِ ﷺ لِمَا يُرْضِي رَسُولَ اللهِ».

560 - Yunus narrated to us, he said: Abu Dawud narrated to us, he said: Shu'bah narrated to us, he said: Abu 'Awn al-Thaqafi informed me, he said: I heard al-Harith bin 'Amr narrating from the companions of Mu'adh from the people of Homs - he said: and he said once: from Mu'adh -,
'When the Messenger of Allah (saw) sent Mu'adh to Yemen, he said to him: "How will you judge if a case is presented to you?" He said: "I will judge by the Book of Allah." He said: "What if you do not find it in the Book of Allah?" He said: "I will judge by the Sunnah of the Messenger of Allah (saw)." He said: "What if you do not find it in the Sunnah of the Messenger of Allah?" He said: "I will exercise my own judgment and spare no effort." He said: Then he struck his hand against my chest and said: "Praise be to Allah, Who has guided the messenger of the Messenger of Allah (saw) to that which pleases the Messenger of Allah."'

Na ka treguar Shube, i cili ka thënë: Më ka njoftuar Ebu Avn eth-Thekafi, i cili ka thënë: Kam dëgjuar el-Harith bin Amrin duke treguar nga shokët e Muadhit prej banorëve të Himsit - e një herë ka thënë: nga Muadhi -,
«Se i Dërguari i Allahut (s.a.v.s.), kur e dërgoi Muadhin në Jemen, i tha atij: Si do të gjykosh nëse të paraqitet ndonjë çështje për gjykim? Ai tha: Do të gjykoj me Librin e Allahut. Pejgamberi tha: Po nëse nuk e gjen në Librin e Allahut? Ai tha: Do të gjykoj me Sunetin e të Dërguarit të Allahut (s.a.v.s.). Pejgamberi tha: Po nëse nuk e gjen në Sunetin e të Dërguarit të Allahut? Ai tha: Do të bëj ijtihad me mendimin tim pa u kursyer. Atëherë Pejgamberi e goditi me dorën e tij në gjoksin tim dhe tha: Falënderimi i takon Allahut, i Cili e udhëzoi të dërguarin e të Dërguarit të Allahut (s.a.v.s.) drejt asaj që e kënaq të Dërguarin e Allahut».
