- حَدَّثَنَا أَبُو دَاوُدَ ، قَالَ: حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ ،
عَنْ جَمِيلِ بْنِ مُرَّةَ ، عَنْ أَبِي الْوَضِيءِ السَّحْتَنِيِّ ،
قَالَ: «خَرَجْنَا فِي غَزَاةٍ لَنَا فَنَزَلْنَا مَنْزِلًا، فَاشْتَرَى
رَجُلٌ عَبْدًا بِفَرَسٍ، فَبَقِينَا بَقِيَّةَ يَوْمِنَا وَلَيْلَتِنَا،
فَلَمَّا كَانَ عِنْدَ الرَّحِيلِ قَامَ الرَّجُلُ إِلَى فَرَسِهِ
لِيُسْرِجَهُ، فَأَخَذَهُ الرَّجُلُ بِالْبَيْعِ، فَاخْتَصَمَا إِلَى أَبِي
بَرْزَةَ الْأَسْلَمِيِّ ، فَقَالَ: أَتَرْضَيَانِ أَنْ أَقْضِيَ
بَيْنَكُمَا بِقَضَاءِ رَسُولِ اللهِ ﷺ؟ إِنَّ رَسُولَ اللهِ - ﷺ - قَضَى
أَنَّهُ الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا»، قَالَ
حَمَّادٌ: وَهَذَا الَّذِي حَفِظْتُهُ أَنَا.
قَالَ حَمَّادٌ: وَقَالَ
هِشَامُ بْنُ حَسَّانَ فِي هَذَا الْإِسْنَادِ: إِنَّ أَبَا بَرْزَةَ
قَالَ: وَلَا أُرَاكُمَا تَفَرَّقْتُمَا.

964 - Abu Dawud narrated to us, he said: Hammad ibn Zayd narrated to us, from Jamil ibn Murrah, from Abu al-Wadi' al-Sahtani, who said: "We went out on an expedition of ours and stopped at a place. A man bought a slave in exchange for a horse. We remained there for the rest of our day and our night. When it was time to depart, the man went to his horse to saddle it, but the other man held him to the sale (refusing to let him take the horse back). They took their dispute to Abu Barzah al-Aslami, who said: 'Do you both agree that I should judge between you with the judgment of the Messenger of Allah (saw)? Indeed, the Messenger of Allah (saw) judged that: The two parties to a transaction have the option (to cancel) as long as they have not separated.'" Hammad said: "And this is what I have memorized."
Hammad said: And Hisham ibn Hassan said regarding this chain of narration: Indeed, Abu Barzah said: "And I do not see that you two have separated."
964 - Na ka treguar Ebu Davudi, i cili ka thënë: Na ka treguar Hammad bin Zejdi, nga Xhemil bin Murra, nga Ebu el-Vadi' es-Sehteni, i cili ka thënë: «Dolëm në një betejë tonën dhe ndaluam në një vend. Një burrë bleu një rob për një kalë. Qëndruam pjesën e mbetur të ditës dhe natën tonë. Kur erdhi koha e nisjes, burri u ngrit te kali i tij për ta shalëzuar, por burri tjetër e kapi për shitblerjen (për ta anuluar). Ata u grindën dhe shkuan te Ebu Berze el-Eslemiu, i cili tha: A jeni të kënaqur që të gjykoj mes jush me gjykimin e të Dërguarit të Allahut (s.a.v.s.)? I Dërguari i Allahut (s.a.v.s.) ka gjykuar se: 'Shitësi dhe blerësi kanë të drejtën e zgjedhjes (për ta anuluar shitblerjen) përderisa nuk janë ndarë'». Hammadi tha: Kjo është ajo që kam mbajtur mend unë.
Hammadi tha: Hisham bin Hassani ka thënë në këtë isnad: Ebu Berze ka thënë: Dhe nuk po shoh që ju të jeni ndarë.
