١١١٨ - حَدَّثَنَا أَبُو دَاوُدَ ، قَالَ: حَدَّثَنَا أَبُو عَوَانَةَ ، عَنْ عَبْدِ الْمَلِكِ بْنِ عُمَيْرٍ ، عَنْ عَلْقَمَةَ بْنِ وَائِلٍ ، عَنْ أَبِيهِ ، قَالَ: «كُنَّا عِنْدَ النَّبِيِّ - ﷺ - فَجَاءَ خَصْمَانِ يَخْتَصِمَانِ فِي أَرْضٍ، أَحَدُهُمَا امْرُؤُ الْقَيْسِ بْنُ عَابِسٍ الْكِنْدِيُّ وَالْآخَرُ رَبِيعَةُ بْنُ عَيْدَانَ، فَقَالَ امْرُؤُ الْقَيْسِ: يَا رَسُولَ اللهِ، إِنَّ هَذَا انْتَزَى عَلَى أَرْضِي! فَقَالَ رَسُولُ اللهِ ﷺ: بَيِّنَتُكَ، قَالَ: لَيْسَتْ لِي بَيِّنَةٌ! قَالَ: إِذًا يَحْلِفُ، قَالَ: يَا رَسُولَ اللهِ، إِذًا يَذْهَبُ بِهَا! فَقَالَ رَسُولُ اللهِ ﷺ: لَيْسَ لَكَ إِلَّا ذَلِكَ، فَلَمَّا قَامَ لِيَحْلِفَ قَالَ رَسُولُ اللهِ ﷺ: أَمَا إِنَّهُ إِنْ حَلَفَ ظَالِمًا لِيَذْهَبَ بِأَرْضِهِ لَيَلْقَيَنَّ اللهَ وَهُوَ عَلَيْهِ غَضْبَانُ».
#1118 1118 - Abu Dawud narrated to us, he said: Abu 'Awanah narrated to us, from 'Abd al-Malik ibn 'Umayr, from 'Alqamah ibn Wa'il, from his father, who said: "We were with the Prophet (saw) when two litigants came disputing over a piece of land. One of them was Imru' al-Qays ibn 'Abis al-Kindi and the other was Rabi'ah ibn 'Aydan. Imru' al-Qays said: 'O Messenger of Allah, this man has seized my land!' The Messenger of Allah (saw) said: 'Your evidence?' He said: 'I have no evidence!' He said: 'Then he (the defendant) shall take an oath.' He said: 'O Messenger of Allah, then he will take it (the land) away!' The Messenger of Allah (saw) said: 'You have nothing other than that.' When he stood up to take the oath, the Messenger of Allah (saw) said: 'Indeed, if he takes a false oath to take away his land, he will surely meet Allah while He is angry with him.'"

1118 - Na ka treguar Ebu Davudi, i cili ka thënë: Na ka treguar Ebu Avane, nga Abdylmelik bin Umejri, nga Alkame bin Vaili, nga babai i tij, i cili ka thënë: «Ishim te Pejgamberi (s.a.v.s.) kur erdhën dy palë ndërgjyqëse që po debatonin për një tokë, njëri prej tyre ishte Imru'ul Kajs bin Abis el-Kindij dhe tjetri ishte Rebi'a bin Ajdan. Imru'ul Kajsi tha: O i Dërguari i Allahut, ky ma ka marrë tokën time! Pejgamberi (s.a.v.s.) tha: Argumentin tënd (sill dëshmitarët). Ai tha: Nuk kam argument! Tha: Atëherë ai (pala tjetër) duhet të betohet. Ai tha: O i Dërguari i Allahut, atëherë ai do ta marrë atë (me betim të rremë)! Pejgamberi (s.a.v.s.) tha: Nuk ke tjetër veç kësaj. Kur ai u ngrit për t'u betuar, Pejgamberi (s.a.v.s.) tha: Nëse ai betohet duke qenë i padrejtë për t'ia marrë tokën atij, me siguri do ta takojë Allahun dhe Ai do të jetë i zemëruar me të».
