أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ ، حَدَّثَنَا سُفْيَانُ ، عَنْ مَنْصُورٍ ، عَنْ إِبْرَاهِيمَ ، عَنْ عَلْقَمَةَ ، عَنْ عَبْدِ اللَّهِ ، فِي رَجُلٍ تَزَوَّجَ امْرَأَةً وَلَمْ يَكُنْ فَرَضَ لَهَا شَيْئًا، وَلَمْ يَدْخُلْ بِهَا، وَمَاتَ عَنْهَا، قَالَ فِيهَا : لَهَا صَدَاقُ نِسَائِهَا، وَعَلَيْهَا الْعِدَّةُ، وَلَهَا الْمِيرَاثُ، قَالَ مَعْقِلٌ الْأَشْجَعِيُّ :" قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي بِرْوَعَ بِنْتِ وَاشِقٍ امْرَأَةٍ مِنْ بَنِي رُوَاسٍ بِمِثْلِ مَا قَضَيْتَ ". قَالَ : فَفَرِحَ بِذَلِكَ، قَالَ مُحَمَّدٌ، وَسُفْيَانُ : نَأْخُذُ بِهَذَا
#1527 Muhammad bin Yusuf informed us, Sufyan narrated to us, from Mansur, from Ibrahim, from 'Alqama, from 'Abdullah, regarding a man who married a woman and had not specified a dower for her, nor had he consummated the marriage with her, and then died leaving her; he said regarding it: "She is entitled to the dower of women of her status, she must observe the waiting period, and she is entitled to inheritance." Ma'qil al-Ashja'i said: "The Messenger of Allah (pbuh) decreed in the case of Birwa' bint Washiq, a woman from Banu Ruwas, the same as what you have decreed." He said: So he was delighted by that.

Transmeton Abdullahu: Lidhur me një burrë që ishte martuar me një grua pa i caktuar asaj mehr (shuma e martesës) dhe kishte vdekur pa pasur marrëdhënie me të, ai tha: "Asaj i takon mehri i grave të ngjashme me të, ajo duhet të qëndrojë në idet (periudhën e pritjes) dhe asaj i takon trashëgimia." Atëherë Ma'kil el-Eshxheu tha: "I Dërguari i Allahut (s.a.v.s.) ka gjykuar për Birua bint Uashikun, një grua nga fisi Benu Ruas, me të njëjtin gjykim si ky i yti." Me këtë rast, ai (Abdullahu) u gëzua shumë.
