Hadith #2146 - Sunan ad-Darimi

أَخْبَرَنَا أَبُو نُعَيْمٍ ، حَدَّثَنَا زُهَيْرٌ ، عَنْ أَبِي إِسْحَاق ، عَنْ الْحَارِثِ الْأَعْوَرِ ، قَالَ : أُتِيَ عَبْدُ اللَّهِ فِي فَرِيضَةِ بَنِي عَمٍّ، أَحَدُهُمْ أَخٌ لِأُمٍّ، فَقَالَ : الْمَالُ أَجْمَعُ لِأَخِيهِ لِأُمِّه، فَأَنْزَلَهُ بِحِسَابِ، أَوْ بِمَنْزِلَةِ الْأَخِ مِنْ الْأَبِ وَالْأُمِّ، فَلَمَّا قَدِمَ عَلِيٌّ ، سَأَلْتُهُ عَنْهَا، وَأَخْبَرْتُهُ بِقَوْلِ عَبْدِ اللَّهِ، فَقَالَ : " يَرْحَمُهُ اللَّهُ، إِنْ كَانَ لَفَقِيهًا، أَمَّا أَنَافَلَمْ أَكُنْ لِأَزِيدَهُ عَلَى مَا فَرَضَ اللَّهُ لَهُ : سَهْمٌ السُّدُسُ، ثُمَّ يُقَاسِمُهُمْ كَرَجُلٍ مِنْهُمْ "

#2146 Abu Nu'aym informed us, Zuhayr narrated to us, from Abu Ishaq, from al-Harith al-A'war, who said: Abdullah was approached regarding an inheritance case involving paternal cousins, one of whom was a maternal brother. He said: "The wealth in its entirety is for the maternal brother," thus treating him in calculation, or in the position, of a full brother from the father and mother. When Ali arrived, I asked him about it and informed him of Abdullah's statement. He said: "May Allah have mercy on him; he was indeed a jurist. As for me, I would not increase him beyond what Allah has ordained for him: a share of one-sixth, then he shares with them as one man among them."

Transmeton El-Harith el-A'uer: Abdullahut (Ibn Mes'udit) iu kërkua gjykimi për trashëgiminë e djemve të xhaxhait, ku njëri prej tyre ishte vëlla nga nëna. Ai tha: "Të gjithë pasurinë e merr vëllai i tij nga nëna", duke e trajtuar atë në pozitën e vëllait nga babai dhe nëna. Kur erdhi Aliu, e pyeta për këtë dhe e njoftova për mendimin e Abdullahut. Ai tha: "Allahu e mëshiroftë, ai vërtet ishte fekih. Sa më përket mua, unë nuk do t'i jepja më shumë sesa i ka caktuar Allahu: pjesën e një të gjashtës, e pastaj ai e ndan pjesën tjetër me të tjerët si njëri prej tyre."
