أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ ، أَنْبَأَنَا الْأَشْعَثُ ، عَنْ الزُّهْرِيِّ ، قَالَ : جَاءَتْ إِلَى أَبِي بَكْرٍ جَدَّةٌ أُمُّ أَبٍ، أَوْ أُمُّ أُمٍّ، فَقَالَتْ : إِنَّ ابْنَ ابْنِي أَوْ ابْنَ ابْنَتِي تُوُفِّيَ، وَبَلَغَنِي أَنَّ لِي نَصِيبًا، فَمَا لِي؟ فَقَالَ أَبُو بَكْرٍ : مَا سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ فِيهَا شَيْئًا، وَسَأَسْأَلُ النَّاسَ، فَلَمَّا صَلَّى الظُّهْر، قَالَ : أَيُّكُمْ سَمِعَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ فِي الْجَدَّةِ شَيْئًا؟ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ : أَنَا، قَالَ : مَاذَا؟ قَالَ :أَعْطَاهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سُدُسًا، قَالَ : أَيَعْلَمُ ذَاكَ أَحَدٌ غَيْرُكَ؟ فَقَالَ مُحَمَّدُ بْنُ مَسْلَمَةَ : صَدَقَ، فَأَعْطَاهَا أَبُو بَكْرٍ السُّدُسَ، فَجَاءَتْ إِلَى عُمَرَ مِثْلُهَا، فَقَال : مَا أَدْرِي، مَا سَمِعْتُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِيهَا شَيْئًا، وَسَأَسْأَلُ النَّاسَ، فَحَدَّثُوهُ بِحَدِيثِ الْمُغِيرَةِ بْنِ شُعْبَةَ، وَمُحَمَّدِ بْنِ مَسْلَمَةَ، فَقَالَ عُمَرُ : أَيُّكُمَا خَلَتْ بِهِ فَلَهَا السُّدُسُ، فَإِنْ اجْتَمَعْتُمَا، فَهُوَ بَيْنَكُمَا
#2199 Yazid ibn Harun informed us, al-Ash'ath told us, from al-Zuhri, who said: A grandmother—either paternal or maternal—came to Abu Bakr and said, "Indeed, my grandson (the son of my son or the son of my daughter) has died, and I have been informed that I have a share of the inheritance, so what is due to me?" Abu Bakr replied, "I have not heard the Messenger of Allah (pbuh) say anything regarding this, but I will ask the people." When he had prayed the Dhuhr prayer, he asked, "Which of you heard the Messenger of Allah (pbuh) say anything concerning the grandmother?" Al-Mughirah ibn Shu'bah said, "I did." He asked, "What was it?" He replied, "The Messenger of Allah (pbuh) granted her a sixth." Abu Bakr asked, "Does anyone else besides you know of this?" Muhammad ibn Maslamah said, "He has spoken the truth." Consequently, Abu Bakr granted her the sixth. Later, another grandmother in a similar situation came to Umar, and he said, "I do not know, for I have not heard anything from the Messenger of Allah (pbuh) regarding this, but I will ask the people." They then narrated to him the hadith of al-Mughirah ibn Shu'bah and Muhammad ibn Maslamah. Umar then said, "Whichever of you is the sole claimant, she shall have the sixth; and if both of you are present, then it is to be shared between you."
