Hadith #2327 - Sunan ad-Darimi

حَدَّثَنَا أَبُو بَكْرِ ابْنُ أَبِي شَيْبَةَ ، عَنْ وَكِيعٍ ، قَالَ : إِذَا كَانَا أَخَوَيْنِ، فَادَّعَى أَحَدُهُمَا أَخًا وَأَنْكَرَهُ الْآخَرُ؟ قَالَ : كَانَ ابْنُ أَبِي لَيْلَى ، يَقُولُ :" هِيَ مِنْ سِتَّةٍ : لِلَّذِي لَمْ يَدَّعِ ثَلَاثَةٌ، وَلِلْمُدَّعِي سَهْمَانِ، وَلِلْمُدَّعَى سَهْمٌ "

#2327 Abu Bakr ibn Abi Shaybah narrated to us, from Waki‘, who said: [If] there are two brothers, and one of them claims [the existence of a third] brother while the other denies him? He said: Ibn Abi Layla used to say: "It is [calculated] out of six: for the one who did not make the claim are three shares, for the claimant are two shares, and for the one claimed [as a brother] is one share."

Transmeton Vekiu: Nëse janë dy vëllezër dhe njëri prej tyre pretendon për një person tjetër se është vëllai i tyre, ndërsa tjetri e mohon këtë, Ibn Ebi Lajla thoshte: "Ajo (trashëgimia) ndahet në gjashtë pjesë: ai që nuk e ka pranuar pretendimin merr tri pjesë, pretenduesi merr dy pjesë, ndërsa ai për të cilin është pretenduar se është vëlla merr një pjesë."
