Hadith #2330 - Sunan ad-Darimi

أَخْبَرَنَا أَبُو النُّعْمَانِ ، حَدَّثَنَا أَبُو عَوَانَةَ ، عَنْ مُغِيرَةَ ، عَنْ الْحَارِثِ الْعُكْلِيِّ : فِي رَجُلٍ أَقَرَّ عِنْدَ مَوْتِهِ بِأَلْفِ دِرْهَمٍ مُضَارَبَةً، وَأَلْفٍ دَيْنًا، وَلَمْ يَدَعْ إِلَّا أَلْفَ دِرْهَمٍ، قَالَ :" يُبْدَأُ بِالدَّيْنِ، فَإِنْ فَضَلَ فَضْلٌ كَانَ لِصَاحِبِ الْمُضَارَبَةِ "

#2330 Abu al-Nu'man informed us, Abu 'Awanah narrated to us, from Mughirah, from al-Harith al-'Ukli: Regarding a man who acknowledged at the time of his death a thousand dirhams as a Mudarabah (profit-sharing investment) and a thousand as a debt, yet he only left behind one thousand dirhams. He said: "The debt is to be prioritized, and if there is a surplus, it belongs to the partner in the Mudarabah."

Transmeton el-Harith el-Ukli: Lidhur me një burrë i cili në prag të vdekjes pranoi se kishte obligim një mijë derhemë si mudarabah dhe një mijë derhemë si borxh, ndërkohë që ai nuk la pas vetëm se një mijë derhemë, ai tha: "Fillohet me borxhin, e nëse mbetet diçka tepër, ajo i takon zotëruesit të mudarabasë."
