Hadith #2424 - Sunan ad-Darimi

حَدَّثَنَا مُحَمَّدُ بْنُ عِمْرَانَ ، عَنْ مُعَاوِيَةَ بْنِ مَيْسَرَةَ بْنِ شُرَيْحٍ ، عَنْ شريح بْنِ الْحَارِثِ ، قَالَ : " اخْتُصِمَ إِلَى شُرَيْحٍ فِي بِنْتَيْنِ، وَأَبَوَيْنِ، وَزَوْجٍ، فَقَضَى فِيهَا، فَأَقْبَلَ الزَّوْجُ يَشْكُوهُ فِي الْمَسْجِدِ، فَأَرْسَلَ إِلَيْهِ عَبْدَ اللَّهِ بْنَ رَبَاحٍ فَأَخَذَهُ، وَبَعَثَ إِلَى شُرَيْحٍ، فَقَالَ : مَا يَقُولُ هَذَا؟ قَالَ : هَذَا يَخَالُنِي امْرَأً جَائِرًا، وَأَنَا إِخَالُهُ امْرَأً فَاجِرًا، يُظْهِرُ الشَّكْوَى وَيَكْتُمُ قَضَاءً سَائِرًا، فَقَالَ لَهُ الرَّجُلُ : مَا تَقُولُ فِي بِنْتَيْنِ، وَأَبَوَيْنِ، وَزَوْجٍ؟ فَقَالَ :لِلزَّوْجِ الرُّبُعُ مِنْ جَمِيعِ الْمَالِ، وَلِلْأَبَوَيْنِ السُّدُسَانِ، وَمَا بَقِيَ فَلِلِابْنَتَيْنِ، قَالَ : فَلِأَيِّ شَيْءٍ نَقَصْتَنِي؟ قَالَ : لَيْسَ أَنَا نَقَصْتُكَ، اللَّهُ نَقَصَكَ، لِلِابْنَتَيْنِ الثُّلُثَانِ، وَلِلْأَبَوَيْنِ السُّدُسَانِ، وَلِلزَّوْجِ الرُّبُعُ، فَهِيَ مِنْ سَبْعَةٍ وَنِصْفٍ فَرِيضَةً، فَرِيضَتُكَ عَائِلَةٌ "

#2424 Muhammad ibn Imran narrated to us, from Muawiyah ibn Maysarah ibn Shurayh, from Shurayh ibn al-Harith, who said: A dispute was brought before Shurayh regarding two daughters, two parents, and a husband, and he issued a ruling on the matter. The husband then went to the mosque complaining about him, so Abdullah ibn Rabah was sent to him, apprehended him, and sent for Shurayh. He asked: What is this man saying? Shurayh replied: This man considers me an unjust man, and I consider him an immoral man; he publicizes his complaint while concealing a standard judgment. The man then said to him: What do you say regarding two daughters, two parents, and a husband? Shurayh said: The husband receives one-fourth of the entire estate, the two parents receive two-sixths, and what remains belongs to the two daughters. The man asked: For what reason did you diminish my portion? Shurayh replied: I did not diminish it; Allah diminished it for you. For the two daughters is two-thirds, for the two parents is two-sixths, and for the husband is one-fourth. Thus, it is calculated from seven and a half as a prescribed share; your prescribed share is subject to awl (proportionate reduction).

Transmeton Shurejh bin el-Harithi: Një rast lidhur me trashëgiminë e dy vajzave, dy prindërve dhe bashkëshortit u dërgua për gjykim te Shurejhi. Ai dha gjykimin e tij për këtë çështje, por bashkëshorti filloi të ankohej kundër tij në xhami. Atëherë Shurejhi dërgoi Abdullah bin Rabahun i cili e mori atë dhe e solli te Shurejhi. Ai tha: "Ky më konsideron njeri të padrejtë, ndërsa unë e konsideroj atë njeri të prishur; ai shfaq ankesën dhe fsheh një gjykim të vlefshëm." Burri e pyeti: "Çfarë thua për rastin e dy vajzave, dy prindërve dhe bashkëshortit?" Shurejhi u përgjigj: "Bashkëshortit i takon një e katërta e të gjithë pasurisë, dy prindërve u takojnë dy të gjashtat, ndërsa ajo që mbetet u takon dy vajzave." Burri tha: "Përse ma pakësove pjesën?" Ai u përgjigj: "Nuk ta pakësova unë, por Allahu ta pakësoi. Dy vajzave u takojnë dy të tretat, dy prindërve dy të gjashtat dhe bashkëshortit një e katërta. Kjo llogaritet nga shtatë e gjysmë si pjesë e caktuar, andaj pjesa jote është e reduktuar."
