أَخْبَرَنَا حَجَّاجٌ الْبَصْرِيُّ ، حَدَّثَنَا أَبُو بَكْرٍ الْهُذَلِيُّ ، عَنْ الشَّعْبِيِّ ، قَالَ : " شَهِدْتُ شُرَيْحًا ، وَجَاءَهُ رَجُلٌ مِنْ مُرَادٍ، فَقَالَ : يَا أَبَا أُمَيَّةَ، مَا دِيَةُ الْأَصَابِعِ؟، قَالَ :عَشْرٌ عَشْرٌ، قَالَ : يَا سُبْحَانَ اللَّهِ، أَسَوَاءٌ هَاتَانِ؟ جَمَعَ بَيْنَ الْخِنْصِرِ وَالْإِبْهَامِ، فَقَالَ شُرَيْحٌ : يَا سُبْحَانَ اللَّهِ، أَسَوَاءٌ أُذُنُكَ وَيَدُكَ؟ فَإِنَّ الْأُذُنَ يُوَارِيهَا الشَّعْرُ، وَالْكُمَّةُ وَالْعِمَامَةُ فِيهَا نِصْفُ الدِّيَةِ، وَفِي الْيَدِ نِصْفُ الدِّيَةِ، وَيْحَكَ : إِنَّ السُّنَّةَ سَبَقَتْ قِيَاسَكُمْ فَاتَّبِعْ وَلَا تَبْتَدِعْ، فَإِنَّكَ لَنْ تَضِلَّ مَا أَخَذْتَ بِالْأَثَرِ، قَالَ أَبُو بَكْرٍ : فَقَالَ لِي الشَّعْبِيُّ : يَا هُذَلِيُّ، لَوْ أَنَّ أَحْنَفَكُمْ قُتِلَ وَهَذَا الصَّبِيُّ فِي مَهْدِهِ أَكَانَ دِيَتُهُمَا سَوَاءً؟، قُلْتُ : نَعَمْ، قَالَ : فَأَيْنَ الْقِيَاسُ؟ "
#2957 Hajjaj al-Basri informed us, Abu Bakr al-Hudhali narrated to us, from al-Sha'bi, who said: "I was present with Shurayh when a man from the tribe of Murad came to him and said: 'O Abu Umayyah, what is the blood money for fingers?' He replied: 'Ten [camels] for each finger.' The man said: 'Glory be to Allah! Are these two equal?'—and he paired the pinky and the thumb together. Shurayh said: 'Glory be to Allah! Are your ear and your hand equal? Verily, the ear is concealed by hair, the cap, and the turban, and yet it carries half the blood money, and the hand carries half the blood money. Woe to you! Indeed, the Sunnah preceded your analogical reasoning, so follow and do not innovate, for you shall never go astray as long as you hold fast to the reports (athar).' Abu Bakr said: Al-Sha'bi then said to me: 'O Hudhali, if the most clement and noble among you were killed and this infant in his cradle, would their blood money be equal?' I said: 'Yes.' He said: 'Then where is the analogical reasoning?'"

Transmeton esh-Sha’bi: Isha dëshmitar kur te Shurejhi erdhi një burrë nga fisi Murad dhe e pyeti: "O Ebu Umeje, sa është dëmshpërblimi (dija) për gishtat?" Ai u përgjigj: "Dhjetë për secilin." Burri tha: "SubhanAllah! A janë këta të dy të barabartë?" – duke bërë bashkë gishtin e vogël dhe gishtin e madh. Shurejhi tha: "SubhanAllah! A janë të barabartë veshi dhe dora jote? Veshi mbulohet nga flokët, kapela dhe çallma, e megjithatë për të paguhet gjysma e dëmshpërblimit, ashtu siç paguhet gjysma e dëmshpërblimit për dorën. Mjerë për ty! Suneti i ka paraprirë analogjisë (kijasit) suaj, andaj pasoni e mos shpikni, sepse nuk do të humbni përderisa kapeni pas traditës (ethert)." Esh-Sha’bi më tha: "O Hudheli, po të vritej më i vjetri e më i nderuari prej jush dhe kjo foshnjë në djep, a do të ishte dëmshpërblimi i tyre i barabartë?" Thashë: "Po." Ai tha: "Atëherë, ku mbetet analogjia?"
