١٥٤٦ - حَدَّثَنَا عَمْرُو بْنُ عَلِيٍّ، ثنا أَبُو قُتَيْبَةَ، ثنا يَعْقُوبُ بْنُ عَبْدِ اللَّهِ بْنِ نُجَيْدِ بْنِ عِمْرَانَ بْنِ حُصَيْنٍ، عَنْ أَبِيهِ، عَنْ عِمْرَانَ بْنِ حُصَيْنٍ، (ح) وَحَدَّثَنَا مُحَمَّدُ بْنُ مُعَاوِيَةَ الزِّيَادِيُّ، ثنا أَبُو دَاوُدَ، ثنا يَعْقُوبُ بْنُ عَبْدِ اللَّهِ بْنِ نُجَيْدٍ، حَدَّثَنِي أَبِي، عَنْ أَبِيهِ، عَنْ عِمْرَانَ بْنِ حُصَيْنٍ، قَالَ: قَتَلَ رَجُلٌ مِنْ هُذَيْلٍ رَجُلا مِنْ خُزَاعَةَ فِي الْجَاهِلِيَّةِ، وَكَانَ الْهُذَلِيُّ مُتَوَارِيًا، فَلَمَّا كَانَ يَوْمُ الْفَتْحِ ظَهَرَ الْهُذَلِيُّ، فَلَقِيَهُ رَجُلٌ مِنْ خُزَاعَةَ فَذَبَحَهُ كَمَا تُذْبَحُ الشَّاةُ، فَقَالَ: «أَقَتَلْتَهُ قَبْلَ النِّدَاءِ، أَوْ بَعْدَ النِّدَاءِ؟» فَقَالَ: بَعْدَ النِّدَاءِ، فَقَالَ رَسُولُ اللَّهِ ﷺ: «لَوْ كُنْتُ قَاتِلا مُؤْمِنًا بِكَافِرٍ لَقَتَلْتُهُ فَأَخْرِجُوا عَقْلَهُ»، فَأَخْرِجُوا عَقْلَهُ، وَكَانَ أَوَّلَ عَقْلٍ كَانَ فِي الإِسْلامِ.
#1546 1546 - Amr ibn Ali narrated to us, Abu Qutaybah narrated to us, Ya'qub ibn Abd Allah ibn Nujayd ibn Imran ibn Husayn narrated to us, from his father, from Imran ibn Husayn. (h) And Muhammad ibn Mu'awiyah al-Ziyadi narrated to us, Abu Dawud narrated to us, Ya'qub ibn Abd Allah ibn Nujayd narrated to us, my father narrated to me, from his father, from Imran ibn Husayn, who said: A man from the tribe of Hudhayl killed a man from the tribe of Khuza'ah during the pre-Islamic period of ignorance (Jahiliyyah), and the Hudhalite man remained in hiding. When it was the day of the Conquest [of Makkah], the Hudhalite appeared, and a man from Khuza'ah encountered him and slaughtered him as a sheep is slaughtered. He [the Prophet] asked: "Did you kill him before the proclamation or after the proclamation?" He replied: "After the proclamation." So the Messenger of Allah (pbuh) said: "If I were to execute a believer for a disbeliever, I would have executed him. So, pay out his blood money." Thus, they paid out his blood money, and it was the first blood money paid in Islam.

١٥٤٦ - Na ka treguar Amr ibn Aliu, na ka treguar Ebu Kutejbe, na ka treguar Jakub ibn Abdullâh ibn Nuxhejd ibn Imran ibn Husajni, nga babai i tij, nga Imran ibn Husajni. (h) Gjithashtu na ka treguar Muhamed ibn Muavije ez-Zijadiu, na ka treguar Ebu Davudi, na ka treguar Jakub ibn Abdullâh ibn Nuxhejdi, më ka treguar babai im, nga babai i tij, nga Imran ibn Husajni, i cili ka thënë: Një burrë nga fisi Hudhejl vrau një burrë nga fisi Huza'ah në kohën e injorancës (Xhahilijetit), ndërsa Hudheliu qëndronte i fshehur. Kur erdhi dita e Çlirimit [të Mekës], Hudheliu u shfaq dhe atë e takoi një burrë nga Huza'ah, i cili e theri ashtu siç theret delja. Ai [Pejgamberi] pyeti: "A e vrave para thirrjes apo pas thirrjes?" Ai u përgjigj: "Pas thirrjes." Atëherë i Dërguari i Allahut (s.a.v.s.) tha: "Sikur të isha që do të ekzekutoja një besimtar për një jobesimtar, do ta kisha ekzekutuar atë. Prandaj, paguani dëmshpërblimin e gjakut (dijen) të tij." Kështu, ata e paguan dëmshpërblimin e tij, dhe kjo ishte dija (dëmshpërblimi i parë i gjakut) që u dha në Islam.
