995 - Na ka treguar Ebu Davudi, i cili ka thënë: Na ka treguar Zem'ah, nga Ez-Zuhriu, nga Ubejdullah bin Abdilah, nga Zejd bin Halidi, i cili ka thënë: «Dy kundërshtarë erdhën te i Dërguari i Allahut (s.a.v.s.) dhe thanë: O i Dërguari i Allahut, të betohemi në Allahun që të gjykosh mes nesh me Librin e Allahut të Madhëruar! Atëherë u ngrit kundërshtari i tij, i cili ishte më i ditur se ai, dhe tha: Po, o i Dërguari i Allahut, gjyko mes nesh me Librin e Allahut dhe më jep leje të flas! Ai i dha leje, e ai tha: O i Dërguari i Allahut, djali im ishte i punësuar te ky njeriu dhe kreu zinà me gruan e tij. Më njoftuan se djali im duhej të vritej me gurë (rexhëm), prandaj unë dhashë si dëmshpërblim për të njëqind dele dhe një shërbëtor. Kur pyeta njerëzit e dijes, më njoftuan se djali im duhet të fshikullohet me njëqind goditje dhe të dëbohet një vit, ndërsa gruaja e këtij duhet të vritet me gurë! Atëherë Pejgamberi (s.a.v.s.) tha: Betohem në Atë, në dorën e të Cilit është shpirti i Muhamedit, unë do të gjykoj mes jush me Librin e Allahut; sa u përket njëqind deleve dhe shërbëtorit, ato të kthehen ty, ndërsa djali yt duhet të fshikullohet me njëqind goditje dhe të dëbohet një vit. Shko o Unejs te gruaja e këtij, e nëse ajo pranon, atëherë gurëzoje atë. Ai shkoi te ajo, e pyeti dhe ajo pranoi, kështu që ai e gurëzoi atë».

- حَدَّثَنَا أَبُو دَاوُدَ ، قَالَ: حَدَّثَنَا زَمْعَةُ ، عَنِ
الزُّهْرِيِّ ، عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ ، عَنْ زَيْدِ بْنِ
خَالِدٍ ، قَالَ: «جَاءَ خَصْمَانِ إِلَى رَسُولِ اللهِ - ﷺ - فَقَالَا:
يَا رَسُولَ اللهِ، نَنْشُدُكَ اللهَ لَمَا قَضَيْتَ بَيْنَنَا بِكِتَابِ
اللهِ ﷿! فَقَامَ خَصْمُهُ وَهُوَ أَفْقَهُ مِنْهُ فَقَالَ: أَجَلْ يَا
رَسُولَ اللهِ، فَاقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَائْذَنْ لِي
فَأَتَكَلَّمَ! فَأَذِنَ لَهُ، فَقَالَ: يَا رَسُولَ اللهِ، إِنَّ ابْنِي
كَانَ عَسِيفًا عَلَى هَذَا، وَإِنَّهُ زَنَى بِامْرَأَتِهِ، فَأُخْبِرْتُ
أَنَّ عَلَى ابْنِي الرَّجْمَ، فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ
وَخَادِمٍ، فَلَمَّا سَأَلْتُ أَهْلَ الْعِلْمِ أَخْبَرُونِي أَنَّ عَلَى
ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَأَنَّ عَلَى امْرَأَةِ هَذَا
الرَّجْمَ! فَقَالَ رَسُولُ اللهِ ﷺ: وَالَّذِي نَفْسُ مُحَمَّدٍ بِيَدِهِ
لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ؛ أَمَّا الْمِائَةُ شَاةٍ
وَالْخَادِمُ فَهُمَا مَرْدُودَانِ عَلَيْكَ، وَعَلَى ابْنِكَ جَلْدُ
مِائَةٍ وَتَغْرِيبُ عَامٍ، وَاغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا
فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا، فَغَدَا عَلَيْهَا فَسَأَلَهَا
فَاعْتَرَفَتْ، فَرَجَمَهَا».
995 - Abu Dawud narrated to us, he said: Zam'ah narrated to us, from al-Zuhri, from 'Ubaydullah bin 'Abdullah, from Zayd bin Khalid, who said: "Two disputants came to the Messenger of Allah (saw) and said: 'O Messenger of Allah, we adjure you by Allah that you judge between us according to the Book of Allah (azwj)!' Then his opponent stood up, and he was more knowledgeable than him, and said: 'Yes, O Messenger of Allah, judge between us according to the Book of Allah and permit me to speak!' So he (saw) gave him permission, and he said: 'O Messenger of Allah, my son was a hired laborer for this man, and he committed adultery with his wife. I was informed that my son was to be stoned, so I ransomed him with a hundred sheep and a female servant. But when I asked the people of knowledge, they informed me that my son is to receive a hundred lashes and be exiled for a year, and that the wife of this man is to be stoned!' The Messenger of Allah (saw) said: 'By the One in Whose Hand is the soul of Muhammad, I will surely judge between you according to the Book of Allah; as for the hundred sheep and the servant, they are to be returned to you, and your son is to receive a hundred lashes and be exiled for a year. And go, O Unays, to the wife of this man, and if she confesses, then stone her.' So he went to her the next morning and asked her, and she confessed, so he stoned her."
